What should I do before I purchase a property?
Firstly, you should contact the local council and request all available documents to check that the property has all necessary approvals. Then, you should enquire about any developments nearby that may affect your enjoyment of the property. You should ensure you have unconditional approval for finance to purchase the property. Finally, you should arrange a pest and building inspection report, a survey if the property includes a house, and one is not available, and a strata inspection report if the property includes a unit.
What is a cooling off period?
This is a period, usually 5 business days, available to purchasers of residential property, which entitles the purchaser to rescind the contract and change their mind after exchange and only lose 0.25% of the purchase price.
Can I negotiate amendments to a contract?
Yes. You should understand the significance of the terms of the contract and if any terms are unreasonable and you do not accept them, you may negotiate an amendment to those terms.
What happens after exchange of contracts?
After exchange, your legal representative will do all things necessary to ensure that you receive what you contracted to receive and that you obtain clear and good title to the property. They will also assist you with your finance, payment of transfer duty and advise you about what is required to carry out any final inspections.
What is involved in electronic conveyancing and how does that affect me?
Most conveyancing of real property now is managed electronically. While this can simplify the settlement process and facilitate the transfer of and payment for property instantaneously, it does require a further understanding of different rules and processes to manage more unique and complex transactions.
Do I still receive a paper certificate of title when I purchase a property?
Since October 2021, paper certificates of title are no longer valid. What this means is that your ownership of a property is recorded electronically, and you no longer need a paper certificate of title to prove your ownership of real property. The advantage to you of not holding a paper certificate of title is that you no longer must be concerned about storing the paper title securely, and there is less chance of any person fraudulently copying or dealing with your certificate of title. Your entitlement is protected by the various steps that must be taken to verify your identification, which in turn supports your ownership of real property.
How do I verify my identification?
The easiest way to verify your identification is to produce your original and valid passport and original and valid driver licence or identification card. If you don’t have a current passport, you may also produce your original or certified copy of your birth certificate and marriage certificate if you changed your name and Medicare card. If any of these are unavailable, there are other options which your legal representative will advise you of. You legal representative will advise you how your identification may then be verified.
